BASE 3 DMCC Membership Agreement
This is the agreement between BASE 3 and any client who signs up to a membership/service, or who wants to train within the facility. It includes the BASE 3 DMCC Participation, Waiver and Release of Liability Agreement (below), and the BASE 3 DMCC Membership Policy. You will be asked to sign both via Wodify prior to training and may review all relevant information on our website at any time.
BASE 3 DMCC PARTICIPATION, WAIVER AND RELEASE OF LIABILITY AGREEMENT
1. INFORMED CONSENT:
I, the Participant, acknowledge that my participation in one or more physical fitness program(s)/class(es) sponsored by BASE 3 (the “Activities”) exposes me to risks of serious bodily injury, including permanent disability, paralysis and death (on the part of myself or an Activity partner), and I, the undersigned, recognise and understand that the programs/classes are not without varying degrees of risk. Risks may arise out of contact and/or participation with other participants, equipment, facility and/or fixed objects; falls, collisions, and other mishaps; exposure to adverse weather conditions and/or high altitude; flaws and defects in equipment and facilities; irregular conditions; negligent coaching and negligent participation. Risks may be caused by my own actions, or inaction, the actions or inaction of others participants, the condition of the facilities in which the Activities take place, and/or the negligence of the "Released Parties." There may be other risks and social and economic losses either not known to me or not readily foreseeable at this time.
2. ASSUMPTION OF THE RISKS:
I, consent to participation in the Activities and fully accept and assume all such risks and all responsibility for losses, costs, and damages incurred as a result of such participation and accept full responsibility for any injury or death that may result from participation in any of the Activities, and I am aware that any of these above mentioned risks may result in serious injury or death to myself and or other participant(s).
3. WAIVER AND RELEASE OF LIABILITY:
In consideration of my participation in the Activities and the above mentioned risks and hazards, I hereby waive, release, discharge, covenant not to sue, and agree to indemnify and save and hold harmless Released Parties from any and all liability, demands, losses, medical expenses, property damage and / or equipment damage, lost opportunities, damages or attorney’s fees and costs arising from my negligent or intentional act or omission in the participation in BASE 3 Activities, and any / or all claims for negligence, expressed or implied warranty, contribution, and indemnity, and/or claims of negligent rescue operations, first aid, and emergency care, or acts allegedly attributed to the negligent acts or omissions of myself or other members to the broadest extent permitted by applicable law. In the event that the Released Parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce This Agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless BASE 3, Released Parties to the fullest extent.
4. FIRST AID AND MEDICAL ATTENTION:
I, (on behalf of my minor, as may be applicable) give my full permission for any person connected with BASE 3 to administer First Aid, as deemed necessary, and in case of serious illness or injury, I give my full permission (on behalf of my minor, as may be applicable) to call for medical and or surgical care and to be transported to a medical facility deemed necessary to administer care and/ or recovery and covenant not to sue, and agree to indemnify and save and hold harmless Released Parties from any and all liability, demands, losses, medical expenses, property damage and / or equipment damage, lost opportunities, damages or attorney’s fees and costs arising from First Aid and / or Medical attention administered.
5. USE OF PICTURE(S)/FILM/LIKENESS:
I agree and forever grant BASE 3 and it's Released Parties to photograph, film and/or likeness of me for advertising purposes. In the event I choose not to allow the use of the same for said purpose, the Participant shall inform BASE 3 in writing.

6. HEALTH DECLARATION:
I understand that certain factors - medication, family history of medical conditions, past injuries and/or illnesses etc - may affect my ability to participate safely in an exercise program. I understand that it is my responsibility to divulge all relevant health/medical information to BASE 3 staff.
I understand that BASE 3 staff are not medical experts and are unable to assess if I can exercise without risking my health or safely. It is, and always will remain, my responsibility to seek expert advice, medical or other, before participating in any activity with BASE 3. I must notify BASE 3 staff should my medical and/or health condition change during my membership, and/or if I believe that any exercise or activity might risk my health and/or the health of others.
I declare that, each time I enter the facility, to the best of my knowledge:
- I am in good physical condition.
- I have no reason, medical or other, why I cannot or should not participate in any activity within the facility, and/or within a group environment.
7. ACKNOWLEDGEMENT OF MEMBERSHIP POLICY:
I agree that I have read, or will take the time to read, the BASE 3 Membership Policy and agree that I am bound by the most up-to-date version at all times irrespective of the date I sign the Membership Agreement.
